Star Telecom transferred services to customers without consent, ACMA finds

An Australian Communications Media Authority (ACMA) investigation has found that BSC WA, trading as Star Telecom, transferred customers to its services without their consent, breaching the Telecommunications Consumer Protections (TCP) Code.

The ACMA said Star Telecom did not comply with customer transfer rules in 10 instances between February 2021 and May 2023.

This included two instances where customers were not informed about the transfer and eight occasions where Star Telecom could not provide evidence that customers had consented to the transfer.

The TCP Code requires telcos to obtain and record a customer’s consent to a transfer from another telco.

The Telecommunications Industry Ombudsman (TIO) alerted the regulator after it received concerns about Star Telecom’s customer transfer practices.

Last week, Urban Telecom landed in hot water after ACMA found that the company’s sales representatives were not properly trained to sell telco services, and was also directed to comply with the TCP code as well.

Telcos face penalties of up to $250,000 for breaching ACMA directions to comply with the TCP Code.
